Changes in the employment of foreigners in Poland

On June 1, new rules regarding the employment of foreigners came into force in Poland. The amendments are aimed at tightening control over the legality of foreigners' employment and apply to both employees and employers.

Key changes:

1. Notice of termination of employment:

The employer is obliged to notify the state authorities if a foreigner who has received a residence card on the basis of work no longer works for the company.

2. Notification in case of absence from work on a visa:

If a foreigner has received a visa on the basis of an invitation from an employer but has not started work, the employer must notify the foreigner, which may result in the visa being canceled.

3. Abolition of the labor market test (Informacja starosty):

When applying for a work permit (Zezwolenie na pracę), it is no longer necessary to provide Informację starosty. This simplifies the procedure and may speed up the processing time.

4. Facilitating the submission of a household card:

When a foreigner applies for a residence card for work, it will not be necessary to provide Informację starosty, as it was before.

➤ Be careful when changing or terminating employment.

➤ Monitor the timing and correctness of the submission of documents.

➤ Control by government agencies will be strengthened.
