INFORMATION CLAUSE

By entering into a vehicle rental/lease agreement with us and a contract for the provision of taxi driver or food delivery services (the "Agreement"), you provide us with your personal data. In this regard, you have the right to receive information about the purpose for which the Company will use it, on what legal basis and what rights you have in this regard.

I. Who is the Administrator of your personal data?

Pursuant to Article 13(1) and (2) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR/RODO), we hereby inform you that the Administrator of your personal data is the company with which you conclude a contract - Qiwi Partner Spółka z ograniczoną odpowiedzialnością, located at: 04-332 Warsaw, Serocka 20, KRS: 950391, REGON: 521209633, NIP: 1133050888 (hereinafter referred to as the "Administrator" or the "Company").

The administrator of the personal data processed through the mobile application of the Service Partner you have chosen (for example, Glovo, Uber, Bolt, Wolt, etc.) is the respective Partner. You will receive information about the processing of your data by such a Partner directly from them.

III. For what purpose and on what legal basis do we process your personal data?

1) If you are the Lessor of the vehicle:

Your data is processed for a purpose:

fulfillment of the concluded contract and settlements (Article 6(1)(b) GDPR)
verification of identity before entering into a contract (legitimate interest of the Company - Article 6(1)(f) GDPR)
fulfillment of accounting and tax obligations (Article 6(1)(c) of the GDPR)
maintaining contact in connection with the performance of the contract (Article 6(1)(f) GDPR)
establishing and defending possible claims (Article 6(1)(f) GDPR)
sending marketing information about the Company's products and services (with your consent regarding the communication channel)
sending marketing information about the products and services of Eternis Group companies (with your consent regarding the communication channel)

2) If you are a Vehicle User:

The purpose and legal basis for processing are similar to those listed above (contractual performance, identity verification, accounting duties, contact, claims, marketing).

3) If you are the Lessee of the vehicle:

The data is processed for the purpose:

contract performance
identity checks
fulfillment of accounting and tax duties
maintaining contact
establishing and defending claims
monitoring of the leased vehicle (the Company's legitimate interest is to ensure the safety of property and fleet management)
Sending marketing information (upon agreement on the communication channel)

4) If you are a Contractor (under a contract of assignment):

The data is processed for the purpose:

contract performance
identity checks
fulfillment of accounting and tax duties
maintaining contact
establishing and defending claims
marketing purposes (as agreed on the communication channel)

5) If you represent a legal entity or are a contact person:

Your data is processed for a purpose:

conclusion and execution of the contract
determination of persons authorized to represent a party to the contract
fulfillment of accounting and tax duties
establishing and defending possible claims
maintaining current communication and correspondence

IV. How long do we process your data?

Your personal data is processed:

during the term of the contract
after its completion - within the period stipulated by law (tax, accounting)
in case of processing on the basis of legitimate interest - until its realization or your objection
in case of processing on the basis of consent - until its withdrawal

The period may be extended if necessary for the defense or assertion of claims.

V. To whom do we share your data?

Your data may be transferred:

to authorized state bodies
Eternis Group companies (within the scope of services provided to the Administrator)
contractors providing services to the Administrator (in particular, IT services)

VI. Is the provision of data mandatory?

Providing personal data is voluntary, but necessary for the conclusion of the contract.

VII. Where did we get your data from?

The data is obtained directly from you or, in the case of legal entities, from the company you represent.

VIII. What rights do you have?

You have the right:

to access their data and receive a copy of it
to correct inaccurate or complete incomplete data
to delete data (in cases provided for by law)
to limit processing
to object to processing (if it is carried out on the basis of legitimate interest)
for data transfer
to file a complaint with the supervisory authority (President of the Office for Personal Data Protection in Warsaw)
